Welcome to Applications.co.zw ("we", "us", "our", or "the Platform"). Applications.co.zw is a digital application marketplace service provided to connect users with applications developed by third-party developers ("Developers" or "Providers"). Your use of Applications.co.zw and the applications, software, games, or other digital content or services (collectively referred to as "Content" or "Apps") available through it is subject to these Terms and Conditions ("Terms").
Important: Applications.co.zw is a discovery and awareness platform. We do not own, develop, distribute, or control the Content available through our platform. All Content is owned, developed, and provided by independent third-party Developers. We simply provide a platform for discovery, information sharing, and awareness of available applications.
By accessing or using Applications.co.zw, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

We Do Not Distribute: Applications.co.zw does not distribute, sell, license, or provide applications directly. We do not host application files for download (unless explicitly provided by Developers through our platform). When applications are available for download, such downloads occur either:
Corporate Applications: Some applications listed on our platform may be developed by or associated with corporate entities. We do not distribute these applications. We provide information and awareness about their existence and availability. Any distribution, licensing, or provision of corporate applications occurs directly between the Developer (or corporate entity) and the end user, independent of Applications.co.zw.
No Endorsement: The presence of Content on our platform does not constitute an endorsement, recommendation, or guarantee by Applications.co.zw. We are not responsible for and do not endorse any Content made available through Applications.co.zw that originates from Developers or third parties.
Content Ownership: All Content available through Applications.co.zw is owned by the respective Developers or their licensors. Applications.co.zw does not claim ownership of any Content. Developers retain all rights, title, and interest in their Content, including intellectual property rights.
Third-Party Content: Content may be offered by Developers or made available by third parties not affiliated with Applications.co.zw. We are not responsible for the accuracy, completeness, legality, or quality of Content provided by third parties. Your use of any Content is at your own risk.
Developer Responsibility: Developers are solely responsible for:
License Agreements: Your use of Content may be governed by separate end-user license agreements ("EULA") or terms of service provided by the Developer. You are responsible for reading and understanding any such agreements before using Content.
Access Requirements: To use Applications.co.zw, you will need a compatible device, working Internet access, and compatible software. The availability of Content and features may vary, and not all Content may be available in your location.
Account Requirements: Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Age Restrictions: You must be at least 18 years old to use Applications.co.zw, or have the consent of a parent or legal guardian if you are a minor. You must comply with any additional age restrictions that might apply for specific Content.
Third-Party Fees: You are responsible for any access or data fees incurred from third parties (such as your Internet provider or mobile carrier) in connection with your use of Applications.co.zw and Content.
Unauthorized Access: You must keep your account details secure and must not share them with anyone else. You must not collect or harvest any personal data of any user of Applications.co.zw.
Free Content: Applications.co.zw may allow you to access information about Content free of charge. Some Content may be free, while others may require payment.
Purchase Contracts: When you purchase Content through Applications.co.zw or links provided on our platform, you enter into a separate sale contract with the Developer or Provider of that Content. Applications.co.zw is not a party to such contracts unless explicitly stated.
Payment Processing: Payment processing for Content purchases may be handled by third-party payment providers, including but not limited to Paynow and other payment services available in Zimbabwe. Applications.co.zw may facilitate payment processing but is not responsible for payment transactions between you and Developers or payment providers.
Payment Provider Terms: You must abide by the terms and conditions of any payment processing method you use, whether provided by Applications.co.zw or a third party. You are solely responsible for all amounts payable associated with purchases you make.
Pricing: Pricing and availability of all Content displayed through Applications.co.zw are subject to change at any time. Prices are set by Developers, not by Applications.co.zw.
Taxes: You are responsible for any duties, customs fees, levies, or taxes (other than income tax) associated with the sale of Content, including any related penalties or interest. You must comply with all applicable tax laws in Zimbabwe.
Refunds: Refund policies are determined by the Developer or payment provider, not by Applications.co.zw. We are not responsible for processing refunds or resolving payment disputes. Please contact the Developer or payment provider directly regarding refund requests.
License to Use Content: After completing a transaction or accessing Content, you will have the rights granted to you by the Developer or Provider of that Content, subject to their terms and conditions. Applications.co.zw does not grant you any rights to Content.

Violation of Terms: If you violate any of these Terms, your rights to use Applications.co.zw may immediately terminate, and we may terminate your access to the platform or your account without refund.
No Warranty: Applications.co.zw is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components.
Content Disclaimers: We do not warrant, endorse, guarantee, or assume responsibility for any Content or services offered by Developers or third parties. We are not responsible for:
Limitation of Liability: To the maximum extent permitted by law in Zimbabwe, Applications.co.zw, its owners, operators, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Corporate Applications: With respect to corporate applications or applications associated with corporate entities, Applications.co.zw explicitly disclaims any liability for:
Wrongful Content: Applications.co.zw does not distribute Content and is not responsible for wrongful, illegal, infringing, or harmful Content. If you encounter such Content, please report it to us, and we will take reasonable steps to address the issue. However, we are not liable for any damages caused by such Content before it is removed or addressed.
Maximum Liability: Our total liability to you for any claims arising from these Terms or your use of Applications.co.zw shall not exceed the amount you paid to Applications.co.zw (if any) in the twelve (12) months preceding the claim, or ZWL 100, whichever is greater.
You agree to indemnify, defend, and hold harmless Applications.co.zw, its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

Removal Rights: We reserve the right to remove or cease providing access to any Content or information on our platform at any time, without notice, for any reason, including but not limited to:
No Guarantee of Availability: We do not guarantee that Content will be available at any particular time or for any particular duration. Content may be removed, modified, or become unavailable at any time without notice.
Developer Discontinuation: Developers may discontinue, modify, or remove their Content at any time. Applications.co.zw is not responsible for notifying you of such changes or for any consequences resulting from Content discontinuation.
If you are a Developer using Applications.co.zw, you agree to:
Storage Limits: Developers are allocated storage space for their Content. Storage usage is tracked and must not exceed allocated limits. Deleted Content will free up storage space automatically.
None of the services or Content available through Applications.co.zw are intended for use in the operation of nuclear facilities, life support systems, emergency communications, aircraft navigation or communication systems, air traffic control systems, or any other activities in which case the failure of the services or Content could lead to death, personal injury, or severe physical or environmental damage. Applications.co.zw and Developers disclaim any liability for such uses.
Platform Intellectual Property: The Applications.co.zw platform, including its design, logos, trademarks, and content created by us, is owned by Applications.co.zw and protected by intellectual property laws.
Content Intellectual Property: All Content is owned by Developers or their licensors. Applications.co.zw does not claim ownership of Content and respects the intellectual property rights of Developers.
Infringement Claims: If you believe that Content on our platform infringes your intellectual property rights, please contact us at support@applications.co.zw with details of your claim. We will investigate and take appropriate action in accordance with applicable law.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Applications.co.zw, you consent to the collection and use of information as described in our Privacy Policy.
Developer Data: We may need to provide your personal information, such as your name and email address, to Developers for the purposes of processing transactions or provisioning Content. Developers agree to use this information in accordance with their privacy policies and applicable law.
Termination by You: You may stop using Applications.co.zw at any time. You may delete your account and Content at any time, which will free up storage space.
Termination by Us: We reserve the right to suspend or terminate your access to Applications.co.zw, your account, or any Content at any time, without notice, for any reason, including but not limited to:
Effect of Termination: Upon termination, your right to use Applications.co.zw will immediately cease. We may delete your account and Content. Provisions of these Terms that by their nature should survive termination will survive, including but not limited to indemnification, limitation of liability, and dispute resolution provisions.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions.
Jurisdiction: Any disputes arising from these Terms or your use of Applications.co.zw shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
Disputes with Developers: Any disputes between you and Developers regarding Content or transactions are between you and the Developer. Applications.co.zw is not a party to such disputes and is not responsible for resolving them. We encourage you to contact Developers directly to resolve disputes.
We may update these Terms from time to time to reflect changes in our services, legal requirements, or for other reasons. If we make material changes to these Terms, we will notify you by:
Your continued use of Applications.co.zw after such changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using Applications.co.zw.
Entire Agreement: These Terms constitute the entire agreement between you and Applications.co.zw regarding your use of our platform and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
Force Majeure: We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or failures of third-party services.
